rs for stealing trade secrets. In its complaint, Express Scripts alleges that former Ernst & Young partner Donald Gravlin “had been sneaking into Express Scripts’ headquarters and stealing confidential and proprietary information belonging to Express Scripts and Medco over the course of several months, with assistance from other E&Y partners and employees.”
The complaint alleges Galvin stole more than 20,000 pages of documents containing pricing information, business projections and strategy. It also states that Gravlin’s motive was “to grow and develop additional business in its health care segment, including potential additional business with Express Scripts, Medco, and their direct competitors.” Reuters reported that Ernst & Young spokeswoman Amy Call Well said “the company conducted an investigation after being notified of the allegations, and found a violation of company policies.” She also told Reuters that Gravlin is no longer with the firm.
The St. Louis Post-Dispatch reported Ernst & Young determined that Gravlin removed “at least 952 files containing confidential and proprietary information and data” from Express Scripts, in addition to performing consultant services for one of Express Scripts’ competitors in 2012. The lawsuit claims the trade secrets include “competitively sensitive cost and pricing information … highly proprietary projections and integration strategy documents … and highly proprietary business strategy and performance metrics documents.”
