A&E is facing a trademark infringement lawsuit based on a popular Duck Dynasty quote, according to The Inquisitr.
Court documents state the conflict all started when Uncle Si, one of Duck Dynasty’s cast members, said, “My favorite color is camouflage.” A&E then used the popular phrase to sell t-shirts and other merchandise.
Fort Pierce-based Hajn LLC filed a lawsuit against A&E, claiming that the U.S. Patent & Trademark Office had already issued it a trademark for the phrase. The suit claims Hajn had been designing, marketing and selling clothes with the trademarked phrase since January 2011.
A&E has generated millions of dollars in revenue from the sale of Duck Dynasty merchandise. The corporation has merchandising contracts with Wal-Mart, Sears, Kohl’s, Sports Authority and Target.
Hajn filed its three-count complaint after A&E rejected Hajn’s demand to cease and desist using its mark. Hajn is alleging both unfair competition and trademark infringement, requesting an injunction to stop A&E from using the phrases “My favorite color’s camo,” and “My favorite color is camo.”
The suit is also seeking money damages, attorney’s fees and a share of the profits that were gained from the use of the trademarked phrase.
